BLACK FLAG TRAINING GROUP RELEASE OF LIABILITY, WAIVER OF CLAIMS,

ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

(hereinafter “The Release Agreement”)

BY SIGNING THIS YOU WILL WAIVER CERTAIN LEGAL RIGHTS,

INCLUDING THE RIGHT TO SUE

PLEASE READ CAREFULLY

THE ACTIVITIES REFERRED TO IN THIS RELEASE AGREEMENT INVOLVE RISKS, DANGERS AND HAZARDS INCLUDING RISK OF DAMAGE, LOSS, PERSONAL INJURY AND DEATH. THESE RISKS, DANGERS AND HAZARDS ARE MORE FULLY DESCRIBED ON THE FOLLOWING PAGES. ALL PARTICIPANTS IN THESE ACTIVITIES ARE REQUIRED TO SIGN THIS RELEASE AGREEMENT WHICH IS INTENDED TO PREVENT PARTICIPANTS FROM SUING IN THE EVENT OF AN ACCIDENT. PLEASE TAKE THE TIME TO REVIEW THIS DOCUMENT CAREFULLY.

DEFINITIONS

In this agreement the term “training programs” shall include all activities, programs, events, classes, and services provided, sponsored or organized by the Operator including training for civilian security military and law enforcement workshop, special events training classes in, martial arts, tactical training strength and conditioning; weight training; personal training; use of strength training and fitness conditioning equipment; orientation or instructional sessions or lessons; outdoor sessions as well and all other such related activities.

ASSUMPTION OF RISKS

 I am aware that my participation in training programs involves many risks, dangers and hazards, which could result in damage, loss or physical injury to me. Some of these risks, dangers and hazards include, but are not limited to:

·         Health: overexertion, dehydration, fatigue, lack of fitness or conditioning.

·         Recognize and understand that martial arts training is an activity that involves physical contact and that my participation might result in serious injury, including permanent disability or even death, and severe social and economic loss.

·         Recognize and understand that such risk may be due to not only my own actions, but also the action, inaction or negligence of others, the regulations of participation, or the conditions of the premises or of any of the equipment used.

·         Recognize that there may be other risks that are not known to me or to others or not reasonably foreseeable at this time.

·         Agree to inspect the facilities, equipment and pairings prior to participation. I will immediately inform an instructor if I believe that anything is unsafe or beyond my capability and refuse to participate.

·         Assume all of the foregoing risks and accept personal responsibility for any damages that may result from injury, permanent disability or death.

·         Enter martial arts training and/or competition entirely of my own free will and understand the importance of following the rules of training and competition.

·         I certify that I am in good physical condition, and have no disease, injury or other condition that would impair my performance or physical and mental well-being during intense training practice and/or competition.

·         Grant permission in case of injury to have a doctor, nurse, athletic training or other emergency medical personnel provide me with medical assistance or treatment for such injury.

·         Release, waive, discharge and covenant not to sue, Black Flag Training Group, its affiliated organizations and governing bodies, their officers, instructors and personnel, other members of the organizations, participants, supervisors, coaches, sponsoring organizations or their agents, and if applicable, owners and leasers of the premises from any and all liability to the undersigned, his or her heirs and next of kin for any and all claims, demands, losses and damages which may be sustained and suffered on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

 In consideration of the Black Flag Training Group allowing me to participate in training programs and permitting my use of their equipment, facilities and services, I hereby agree as follows:

 1. TO WAIVE ANY AND ALL CLAIMS that i have or may in the future have against Black Flag Training Group and to release the Black Flag Training Group from any and all liability for any loss, damage, expense or injury including death that i may suffer as a result of my participation in training programs due to any cause whatsoever, including but not limited to:

·         negligence on the part of the Black Flag Training Group;

·          breach of contract by the Black Flag Training Group;

·          breach of warranty on the part of the Black Flag Training Group in respect of the design, manufacture, selection, installation, maintenance or adjustment of equipment;

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage, loss, expense or injury to any third party resulting from my participation in training programs.

3. This Agreement shall be effective and binding upon my heirs, executors, administrators, assigns and representatives, in the event of my death or incapacity.

 SAFETY I am familiar with the proper use of the equipment. I am aware that there are training instructors and staff available to answer any questions I may have as to the proper use of the equipment. In entering into this Agreement, I am not relying on any oral, visual or written representations or statements made by the Black Flag Training Group with respect to the safety of training programs other than what is set forth in this Agreement.

INSURANCE: I am aware that the Black Flag Training Group does not provide me with any disability, accident, liability or medical insurance or compensation, should I become injured or cause personal injury or property damage to any third party while participating in training programs.

 JURISDICTION: This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the United States, and I agree to attorney solely to the jurisdiction of the Courts of the United States.
